SWMLS is excited to announce a new MLS Disclosure field and Document Type in the FlexMLS system.
The new Field name is called "RANM 2100 Disclosure," and should be marked as "YES" if there is an applicable disclosure identified from RANM Form 2100 – Supplemental Broker Duties Disclosure. There is also a new Document Type called "Form 2100 – Broker Duties Supplemental" that can be selected when adding this form, when applicable, to your MLS listings.
Report "YES" for RANM 2100 Disclosure if you can answer "YES" to any of the Form 2100 disclosures in this list below.
• Written Brokerage Relationships with Other Parties – Are there any written brokerage relationships that the Broker has with any other parties to the transaction?
• Conflict of Interests/Material Interest or Relationship – Are there any conflicts of interest, including any material interest or relationship of a business, personal, or family nature that the Broker has in the transaction?
• Adverse Material Facts – Are there any adverse material facts relating to the property or transaction which the broker actually knows? It is not necessary for the Broker to disclose adverse material facts that the seller has previously disclosed in writing to the buyer.
As part of this change, SWMLS has also added a new Document Type called "Form 2100 – Broker Duties Supplemental." SWMLS rules do not require that the RANM Form 2100 is added to applicable listings but encourages having this form added when you disclose YES for the new Form 2100 disclosure field.
This new change was done so that other SWMLS REALTORS who see the listing prior to making an offer will know that the Listing Broker is identifying that they have a certain material interest, relationship, or knowledge of adverse facts that would require the RANM Form 2100 - Broker Duties Supplemental Disclosure to be used in the purchase of that property.
