The unauthorized use of Photos is a major issue in the Real Estate Industry, and Southwest MLS is taking action to prevent it.
Beginning November 1st, an immediate fine of $250 per listing will be imposed for each offense of unauthorized copying of photos.
This is the rule language that will be added to Section 9.1.1:
Before using a photo, ask yourself three questions:
- Did I capture the picture on my camera?
- Have I paid someone to use this photo?
- Do I have written permission to use this photo?
If the answer to all three of those questions is no, do not use the photo!

In addition to the $250 fine that could be levied by Southwest MLS, you could also be subject to legal claims by the copyright holder. There are photographers nationwide that aggressively pursue real estate licensees that use their photos without permission and have sent invoices to these licensees for upwards of $5,000 to pay for their use of a single photo.
