To streamline the process for handling minor ethics violations, GAAR has implemented the Ethics Citation Program, an efficient alternative to lengthy formal hearings.
This program offers a quicker resolution to specific Code of Ethics violations, encouraging accountability while protecting both the complainant’s anonymity and the respondent’s rights.
Why the Citation Program?
Filing an ethics complaint can feel overwhelming, often due to concerns about time, retaliation, or reputational impact. The Citation Program removes these barriers by offering:
- A faster process: Avoids drawn-out hearings for minor violations.
- Confidentiality: Complainants remain anonymous, reducing concerns about retaliation.
- Clear guidelines: Only specific violations qualify for citation-based resolution.
- Fair enforcement: Respondents have the right to request a hearing if they choose.
How It Works
- Filing a Complaint: Anyone can file a complaint within 180 days of the incident.
- Review Process: GAAR’s Grievance Committee assesses if the complaint qualifies.
- Citation Issuance: If applicable, a Citation Panel assigns a fine or required ethics training.
- Respondent’s Rights: The accused can accept the citation or request a hearing within 20 days.
- Fines & Compliance: Fines range from $500 to $3,000, with training options for first-time offenses.
Limitations & Fines
- A REALTOR® may receive up to two citations in 12 months or three in 36 months.
- The maximum cumulative fine within three years is $5,000.
- Fines increase for repeat offenses, but a first-time offender may complete an ethics course instead of paying a fine.
