The National Association of REALTORS® enforces a strict antitrust policy to ensure fair competition within the real estate industry. This policy aligns with federal and state antitrust laws, which prohibit activities that restrain trade or create monopolies.
Key elements of NAR’s antitrust policy include:
- Prohibition of Price-Fixing: Members cannot discuss or agree on commission rates, fees, or business terms with competitors.
- No Group Boycotts: REALTORS® cannot collectively refuse to work with certain brokers, service providers, or platforms.
- Market Allocation Ban: Dividing territories or clientele among competitors is strictly forbidden.
- Avoiding Misuse of MLS: Multiple Listing Services (MLS) must be open and fair, ensuring equal access to listings without anti-competitive restrictions.
To comply, REALTORS® should avoid discussions on fees, competitive strategies, or exclusionary practices. NAR regularly updates its policies and provides training to ensure ethical and legal conduct.
By adhering to these guidelines, NAR promotes a competitive marketplace that benefits both real estate professionals and consumers.
